The prices quoted by Kramer Toys GmbH, PonyCycle Switzerland include, unless otherwise stated, the statutory value added tax. The prices are purely net in Swiss francs (CHF).

Within Switzerland, Kramer Toys GmbH, PonyCycle Switzerland delivers free of shipping costs. Shipping costs for foreign orders are shown separately in the order process. For rentals shipping costs will be charged additionally.

Technical changes, errors and misprints are reserved, in particular Kramer Toys GmbH, PonyCycle Switzerland may make price changes at any time without notice. Consulting and support services are not included in the sales prices.

 

4 Conclusion of contract
The offers on this website represent a non-binding invitation to the customer to order products and/or services from Kramer Toys GmbH, PonyCycle Switzerland. By placing an order via this website including the acceptance of these GTC, the customer submits a legally binding offer to conclude a contract. Kramer Toys GmbH, PonyCycle Switzerland then sends an automatic "Order Confirmation" by email, which confirms that the offer of the customer has been received by Kramer Toys GmbH, PonyCycle Switzerland. Placed orders are binding for the customer. Unless otherwise stated, there is no right of return or withdrawal.

The contract is concluded as soon as Kramer Toys GmbH, PonyCycle Switzerland sends a declaration of acceptance by email, in which the shipment of the ordered products or services is confirmed.

Orders will only be shipped after full payment has been received (exception: delivery against invoice) and if the goods are available. If the customer's payment has already been received by Kramer Toys GmbH, PonyCycle Switzerland, the payment will be refunded to the customer. If no payment has been made yet, the customer will be released from the obligation to pay. Kramer Toys GmbH, PonyCycle Switzerland is not obliged to make a replacement delivery in the event of a contract cancellation.


5. payment options and retention of title
The customer has the payment options specified in the ordering process. (Visa, Mastercard, E Finance, Postcard, Paypal, cash payment).



Kramer Toys GmbH, PonyCycle Schweiz behält sich das Recht vor, Kunden ohne Angabe von Gründen von einzelnen Zahlungsmöglichkeiten auszuschliessen oder auf Vorauskasse zu bestehen.

Kramer Toys GmbH, PonyCycle Schweiz kann bei Zahlungsverzug des Kunden Verzugszinsen von 5% pro Jahr sowie eine Mahngebühr von maximal CHF 20.- pro Mahnung erheben.
Die dem Kunden gelieferten Produkte bleiben bis zur vollständigen Bezahlung im Eigentum von Kramer Toys GmbH, PonyCycle Schweiz


6 Delivery, duty to inspect, notice of defects and return
Deliveries are sent by mail or courier service to the address specified by the customer in the order. The invoice will be sent by email or by post. With the shipment, the benefits and risks are transferred to the customer, to the extent permitted by law.

If the delivery is not deliverable or if the customer refuses the acceptance of the delivery, Kramer Toys GmbH, PonyCycle Switzerland can dissolve the contract after a notice of complaint by email to the customer and under appointment of a reasonable period as well as charge the costs for the handling.

The customer is obliged to check the delivered goods immediately after receipt of the delivery and to report any defects, for which Kramer Toys GmbH, PonyCycle Switzerland is liable, immediately in writing by letter or email to the address in the imprint .

Returns to Kramer Toys GmbH, PonyCycle Switzerland are at the expense and risk of the customer. The customer has to send the goods in their original packaging, complete with all accessories and together with the delivery bill and a detailed description of the defects to the return address given by Kramer Toys GmbH, PonyCycle Switzerland in the imprint .

If the inspection by Kramer Toys GmbH, PonyCycle Switzerland shows that the goods have no detectable defects or that they are not covered by the manufacturer's warranty, Kramer Toys GmbH, PonyCycle Switzerland may charge the customer for the expenses, the return shipment or the possible disposal.


7. Widerrufsrecht
Dem Kunden wird während 10 Kalendertagen nach Erhalt der Ware ein Widerrufsrecht gewährt. Die Frist gilt als eingehalten, wenn der Kunde den schriftlichen Widerruf per Email (info@ponycycle-schweiz.ch) oder Brief (Kramer Toys GmbH, Schwarzhaarhalde 7, 4665 Oftringen) innerhalb der Frist an Kramer Toys GmbH, PonyCycle Schweiz abschickt. Der Widerruf bedarf keiner Begründung.

Die Ausübung des Widerrufsrechts führt zu einer Rückabwicklung des Vertrages. Der Kunde muss die Waren innert 10 Kalendertagen originalverpackt, komplett mit allem Zubehör und zusammen mit dem Lieferschein an die von Kramer Toys GmbH, PonyCycle Schweiz angegebene Rücksendeadresse im Impressum zurücksenden. Rücksendungen an Kramer Toys GmbH, PonyCycle Schweiz erfolgen auf Rechnung und Gefahr des Kunden. Eine allenfalls bereits geleistete Zahlung wird innerhalb von 20 Kalendertagen an den Kunden zurückerstattet, sofern Kramer Toys GmbH, PonyCycle Schweiz die Ware bereits zurückerhalten hat oder der Kunde einen Versandnachweis erbringen kann.

Kramer Toys GmbH, PonyCycle Schweiz behält sich vor, für Beschädigungen, übermässige Abnutzung oder Wertverlust aufgrund unsachgemässem Umgang angemessenen Entschädigung zu verlangen und die Wertminderung vom bereits bezahlten Kaufpreis abzuziehen oder dem Kunden in Rechnung zu stellen.

In folgenden Fällen wird kein Widerrufsrecht gewährt:

  1. If the contract has an element of chance, namely because the price is subject to fluctuations over which the provider has no control.
  2. If the subject of the contract is a movable item which, due to its nature, is not suitable for return or may spoil quickly;
  3. If the subject of the contract is a movable item that is made according to the specifications of the consumer or clearly tailored to personal needs;
  4. If the subject matter of the contract is digital content and such content is not provided on a fixed data carrier or if the contract is to be performed in full by both contracting parties immediately;
  5. If the subject of the contract is a service and the contract is to be fully performed by the provider with the prior express consent of the consumer before the withdrawal period has expired.
  6. In the areas of accommodation, transportation, delivery of food and beverages, and recreational activities, if the provider undertakes at the conclusion of the contract to provide the services at a specific time or within a specified period.


8 Warranty
Kramer Toys GmbH, PonyCycle Switzerland endeavors to deliver goods in perfect quality. In case of defects notified in due time, Kramer Toys GmbH, PonyCycle Switzerland warrants the goods purchased by the customer to be free from defects and to be in good working order during the statutory warranty period of generally two years from the date of delivery. It is at the discretion of Kramer Toys GmbH, PonyCycle Switzerland to provide the warranty by free repair, equivalent replacement or by refund of the purchase price. Further claims are excluded.

Normal wear and tear as well as the consequences of improper handling or damage by the customer or third parties as well as defects caused by external circumstances are not covered by the warranty. Likewise, the warranty for consumables and wear parts is excluded.

Kramer Toys GmbH, PonyCycle Switzerland is not able to give assurances or guarantees for the topicality, completeness and correctness of the data as well as for the constant or undisturbed availability of the website, its functionalities, integrated hyperlinks and further contents. 9 Liability

In the event of any dispute, Swiss substantive law shall apply exclusively to the exclusion of conflict of laws rules. The UN Convention on Contracts for the International Sale of Goods (CISG, Vienna Sales Convention) is explicitly excluded.

The place of jurisdiction is Oftringen, unless the law provides for mandatory places of jurisdiction.
